The licensing authority’s final decision is based on the application documents, the reports by the authorised experts and, if available, the statement by the BMU and the authorities consulted, the findings from objections raised at the public hearing, and, if appropriate, the results of the environmental impact assessment, in their entirety.

The licensing authority’s decision may be appealed before the higher administrative court or the administrative court of the Land concerned insofar as the complainant is able to assert a possible violation of his or her rights or if a right to bring class actions exists.
